Understanding the New Jersey Open Public Records Act
What is OPRA?
The New Jersey Open Public Records Act (OPRA), signed into law in 2002, gives the public the right to access certain government records held by state and local agencies. Through OPRA, residents, journalists, attorneys, and businesses can request copies of public documents to better understand how government operates and how decisions are made.
The Monmouth County Sheriff's Office is committed to honoring OPRA requests promptly and in accordance with the law. Most requests are responded to within seven business days of receipt.
Types of Records You Can Request
- Policy & procedure documents governing Sheriff's Office operations
- Statistical reports and annual summaries
- Incident reports (subject to redaction requirements)
- Internal Affairs summary reports
- Budget and financial documents
- Training records and certifications
- Correspondence and meeting minutes (where applicable)
What is NOT Releasable Under OPRA
Some records are exempt from disclosure under OPRA, including but not limited to:
- Active criminal investigative records
- Personnel and medical records
- Victim and witness information protected by law
- Records that would compromise public safety or security
- Attorney-client privileged communications
- Juvenile records protected by statute
If your request is denied in whole or in part, you will receive a written explanation citing the legal basis for the denial.
Fees & Response Times
Standard copy fees may apply for paper records. Electronic records delivered by email are typically provided at no charge. Larger or more complex requests may require additional time beyond the standard seven business days; in such cases, you will be notified in writing of the expected response date.
